Owners' Associations Must be Public

Look up HOAs in Alabama

Property Owners' Associations must be registered with the state of Alabama to do business here. It's easy to look up an association at the secretary of state's Business Entity Search. Search Here: HOA Directory 

If your association isn't registered, it cannot enforce liens, foreclose, enforce dues, or enter into enforceable contracts. (You can try, but you will lose in court.)


Look up Association Documents

Every association must record their Declaration of Covenants, Conditions, and Restrictions (CC&Rs), (sometimes called "Covenants," or just "Agreement") as well as all Amendments, Bylaws, Lien Notices, HOA Notices, Plats, Maps, and other community documents with the county recorder’s office in the county where the association property is located. These documents must be recorded with the county land records to be enforceable. If your county records are online you can find that web address here: Alabama County Offices.


Association Records must be Readily Available

All Alabama property associations must be non-profits and the various codes for property associations and non-profits require that all the above documents as well as budgets be reasonably available to members as well as anyone interested in purchasing property in the association. Its 2025, so "reasonably available" essentially means online and immediate. If your association does not have a website, there are pay services and free websites your association can use depending on your needs and how big your association is.
